A lawsuit filed initially by two claimants Douglas Babcock and Fred Small in 2012 against the Atlantic Lottery Corporation (ALC) may have far reaching effects on the VLT sector across Canada.
Certified a class suit in 2017 which may involve up to 30,000 players, the claim seeking damages equal to the “unlawful gain” by the Crown corporation through VLT’s since 2006 was given the green light by an appeals court judge in the Newfoundland and Labrador province.
Legal representatives for the claimants allege VLT’s use cognitive deception to create a perception regarding chances of winning which the Atlantic Lottery Corporation disputes saying winning is decided entirely by chance.
The appeals judge accepted the claim of cognitive distortion regarding the perception of winning as a potential argument ruling that the case may go ahead.
