A proposal to regulate and licence daily fantasy sports in New York state gained an important ally this week when Sen. David Carlucci agreed to support a bill introduced recently to the Assembly by Assemblyman Felix Ortiz. Carlucci’s support could give the bill a foothold in the state Senate as well as the Assembly.
The Ortiz bill proposes to give the New York Gaming Commission jurisdiction to regulate DFS within state borders with a range of consumer protection and other safeguards built into the regulations. The bill does not differentiate between daily fantasy games and more traditional, season-long contests.
It followed a clash over the legality of DFS between the state Attorney General and major DFS operators which ended up in the courts, the award of a temporary restricting injunction, an appeal and a stay of execution until January next year.
Carlucci described the Ortiz bill as “a common-sense measure” this week, opining:
“There are so many questions surrounding fantasy sports, which have grown in popularity. We just need to give the proper regulating ability here in New York to protect the consumers and make sure that people aren’t being taken advantage of, and the Gaming Commission is the appropriate place to do it.”
