Paul Phua, the Malaysian high roller gambler and businessman who was arrested last year on charges of illegal sports betting whilst the World Cup football was in progress, is off the hook at last.
Almost a year on, and after two court actions which federal prosecutors lost due to the tainted nature of the state’s evidence Nevada US Attorney Daniel Bogden, confirmed to the publication Las Vegas Review Journal on Thursday that the government will not be launching further appeals against its defeat.
In the last court action on June 1 this year, U.S. District Judge Andrew Gordon dismissed the case, finding that Phua’s rights were violated when FBI agents entered his Caesars Palace villa posing as Internet repairmen in order to gather evidence for a subsequent search warrant.
“On behalf of Mr Phua, we are pleased that the wisdom of Judge Gordon’s decision is not being challenged,” defence lawyer David Chesnoff commented.
