The Kentucky Attorney General, Jack Conway, has issued an opinion confirming that sweepstakes-style gambling through internet cafes is an illegal activity in the state following warnings earlier this year to operators (see previous reports).
The opinion immediately triggered the departure of the operator of the Lucky 7 internet cafe in Ashland, along with his computer hardware.
Adding to the anti-internet gambling pressure, two state senators have launched a measure in the state General Assembly defining computers as gambling devices and making prosecutions easier.
AG opinions are just that, and although state officials are expected to use such views as guidelines, they do not supercede the force of law or the rights of the judiciary to rule on disputed issues.
