A Dutch appellate court backed the country’s gambling regulator last week when it ruled in favour of the Kansspelautoriteit’s (KSA) imposition of a Euro 200,000 fine on Imperial E-Club who reportedly ignored numerous warnings in 2014 to cease its illegal activity in the Dutch market through seven of its online operations (see previous reports).
Imperial E-Club in its defence claimed the KSA’s action conflicted with European regulations, a statement the court rejected as the company is based in the Antigua and Barbuda jurisdiction.
Other objections lodged by Imperial E-Club, covered the amount of the fine, claims that the KSA has not proven the company had exhibited prohibited behaviour and a challenge on the KSA’s priority policy were all dismissed by the Court.
It’s the end of the road for Imperial E-Club in this case, as the KSA points out, Dutch Law allows no further appeal once a ruling has been handed down by the Administrative Law Division of the Council of State.
