The Full Court of the Federal Court today allowed an appeal lodged by Tabcorp and the State of Victoria against a Federal Court judgment in August 2011. The case, initially brought by Sportsbet Pty Ltd (owned by Irish betting company Paddy Power), related to the operation of branded self-service Internet betting kiosks.
The judgment handed down by Justices Emmett, Kenny and Middleton was unanimous and follows the appeal being heard in February 2012.
The immediate effect of the decision is that Sportsbet is prohibited from installing and operating its betting kiosks in Victorian licensed premises and other retail spaces.
“Tabcorp welcomes this judgment,” a company statement Friday noted. “This decision will help ensure a healthy Victorian racing industry and allows the Victorian Government to regulate betting in public places in Victoria.”
