On Friday the US Department of Justice formally filed its brief opposing New Jersey‘s attempt to introduce legalised sports betting within its borders, allying itself with the national sports leagues seeking to derail the Garden State’s initiative .
All parties now have until February 7 to respond to the DoJ brief, with Judge Michael Shipp scheduled to hear oral arguments on February 14.
New Jersey claims that the federal 1992 Professional and Amateur Sports Protection Act is unconstitutional in that it is discriminatory, restricting sports betting to just four states.
Supporting the state’s new law allowing intrastate sports betting are the Thoroughbred Horsemen’s Association, the Atlantic City casinos, state Senate President Stephen Sweeney and Assembly Speaker Sheila Oliver.
